What to do if you’re in an accident with a drunk driver:

Call the Police – ASAP

Do not feel “bad” for the driver even if he/she asks you not to call the police. Drunk drivers like to “negotiate” with victims and pray off sympathy. He/she should not have been drinking and driving. You should not suffer for their poor decision.

Take A Lot of Pictures

Drunk drivers are substantially more likely to leave the scene of the crash (i.e. hit and run). Take pictures of the other driver, driver’s license plate, vehicle registration and property damage. Take pictures of any contraband you find (i.e. driver throwing out beer bottles or marijuana pipe). This will help law enforcement locate the driver in the event he/she leaves the scene. If you are concerned for your safety, remain in the car with the doors locked with the police on the phone.

Tell the Police the Other Drive is Drunk

When the police arrive, advise them of what you saw/heard concerning the driver’s impairment. Tell the officer if the driver has red, watery, bloodshot eyes, slurred speech, trouble with balance and coordination or any statements like, “I shouldn’t have drank so much, etc.” Make sure to tell the officer that you saw the driver behind the wheel of the vehicle (if the parties are now outside the vehicle) as this is a necessary element of the crime.

Tell the Police Your Injured

If you’re injured, make sure you tell the officer. It is more likely they will perform a DUI investigation if you claim injuries.

Get Treatment Immediately

Receive treatment if you’re injured. If necessary, go to the hospital.
