Who is at Fault?

The insurance policy at play depends on who caused the crash, if the rideshare app was on, and more. Generally, you (the victim) will fall under one of the following categories:

Uber or Lyft Passenger

  • If the rideshare driver caused the crash, Uber or Lyft’s $1 million bodily injury policy will cover you.
  • If another driver caused the crash, their insurance policy will be used first. If it is not large enough to cover your damages, Uber or Lyft’s UM policy will kick in next.

Uber or Lyft Driver (Other Driver is at Fault)

  • If the app was on and you were available or waiting for a ride request, the other at-fault driver’s insurance policy is pursued first. If that is not enough, Uber’s UM policy may apply.
  • If the app is not on, only the other driver’s policy will apply.
  • If the app is on and you had a passenger in the car or were en route to pick up a passenger, the other driver’s insurance is used first, and if it is not enough, Uber or Lyft’s UM policy will apply.

Non Occupant (Pedestrian, Cyclist, or Occupant of Another Vehicle)

  • If the app was on and the Uber/Lyft driver was waiting for a ride request or available for a ride, the maximum policy is
    • $50,000 bodily injury per person;
    • $100,000 per accident; and
    • $25,000 in property damage per accident.
  • If the Uber/Lyft driver was en route to pick a passenger up or had a passenger in the car, Uber or Lyft’s $1 million bodily injury policy will apply.
  • If the app was off, only the driver’s personal auto insurance applies.
