What is Defined as a Moped in Florida?
While the term “Moped” is often used to describe any type of motorcycle-style scooter (with two wheels and a seat), it is actually a brand name. However, Florida law recognizes these types of scooters specifically as “Mopeds.” A moped, defined by Florida law, has:
- A seat or saddle;
- No more than three wheels;
- A motor not capable of going speeds over 30 miles per hour on level ground; and
- If an internal combustion engine is used, it cannot be larger than 50 cubic centimeters.

A “Motorized Scooter” (the type that the user stands on while operating), is defined by Florida law as such:
- No seat;
- No more than three wheels; and
- A motor not capable of going speeds over 30 miles per hour on level ground; and

They also have many of the same obligations, such as using turn signals, having head and tail lights, and obeying posted speed limits.
