What is Defined as a Moped in Florida?

While the term “Moped” is often used to describe any type of motorcycle-style scooter (with two wheels and a seat), it is actually a brand name. However, Florida law recognizes these types of scooters specifically as “Mopeds.” A moped, defined by Florida law, has:

  • A seat or saddle;
  • No more than three wheels;
  • A motor not capable of going speeds over 30 miles per hour on level ground; and
  • If an internal combustion engine is used, it cannot be larger than 50 cubic centimeters.

A “Motorized Scooter” (the type that the user stands on while operating), is defined by Florida law as such:

  • No seat;
  • No more than three wheels; and
  • A motor not capable of going speeds over 30 miles per hour on level ground; and

Moped riders have many of the same rights to the road that motorcyclists and car drivers have. They also have many of the same obligations, such as using turn signals, having head and tail lights, and obeying posted speed limits.
